Ejecting Blackwater Doesn’t Solve the Problem

So much for that legal loophole I’ve written about beforethat would have allowed Blackwater Worldwide to continue guarding U.S. officials in Iraq without being subject to Iraqi law. Well, the loophole’s still in place, but now, as Spencer wroteearlier, the government of Iraq has refused to renew Blackwater’s license to operate in the country.
Unfortunately, that doesn’t solve the problem of lawlessness among some contractors in Iraq. From what I can tell, the Status of Forces Agreement still doesn’t apply to private security guards under contract with the Department of State, as it does to the Defense Department.
So whatever new companies are hired in the future –- and it’s likely to be a company, as opposed to U.S. soldiers, given the Obama administration’s promises to withdraw troops in Iraq and beef up presence in Afghanistan -– still may not be subject to either Iraqi or U.S. law.
