In April, The Minnesota Independent reportedthat state Supreme Court Justice Christopher Dietzen, an appointee of Gov. Tim Pawlenty (R-Minn.) had made two donations to former Sen. Norm Coleman’s (R-Minn.) 2008 campaign. Dietzen did not recuse himself from the case. Instead, Dietzen said this to Coleman’s lawyers during Monday’s hearing on the Senate race:
You’re offering little more than … Coleman’s theory of the case but no concrete evidence to back it up.
If Dietzen doesn’t rule for Coleman it’s more or less impossible for Coleman to win at the state Supreme Court. Really, for all of the fuss about Pawlenty’s decision not to run for governor in 2010, the only remaining question is whether the five justices order an election certificate as they rule for Franken.
