Yesterday, it was Sen. Jim Inhofe (R-Okla.) citing“Climategate” as reason to doubt the legitimacy of the EPA’s recent findingthat greenhouse emissions threaten public health. Today it’s Sen. Charles Grassley (R-Iowa) offering the same critique. In a call with reporters, Grassley said Congress never intended for the Clean Air Act to cover carbon dioxide.
“As a person who was here when the last Clean Air Act passed, I can tell you that there was no intention of covering CO2, as one example,” he said.
“„Now you’re having these e-mails come in that are being exposed where they’ve been trying to compromise science. In other words, scientists have been trying to compromise scientists.
“„So it raises the whole issue whether the endangerment basis for doing it, which is the basis for EPA doing it, is even legitimate.
If congressional opponentsof the EPA’s finding aren’t successful in overriding them, Grassley cautioned, the courts will likely take up the issue.
“There’s going to be lawsuits filed against the constitutional authority, the statutory authority of the — of the EPA to do this,” he said.
