WSJ: EPA Doc Could Serve as ‘Legal Roadmap’

The Wall Street Journal managed toget a look at the previously-undisclosed Environmental Protection Agency draft report that the White House has tried to squash. The WSJ reports that the contentious document — which is the result of a multi-million dollar two-year study — could potentially serve as a "legal roadmap" for regulating green-house gas emissions. The report was written in response to a 2007 U.S. Supreme Court decision that found green-house gases can be regulated under the Clean Air Act. When the agency sent off its response to the high court’s decision via email, the White House never opened it.
EPA’s report lays out how green-house gas emissions should be regulated under the Clean Air Act, but the White House’s Office of Management and Budget wants to see that changed. OMB has argued that EPA should push for new regulatory legislation, presumably more lax, rather than the environmental law first passed in the 1970’s. It’s a standoff that has come under congressional heat and isn’t likely to disappear.
