“„[H]as [John McCain] lookedat the charges against these guys? I mean, McCain is a senator, he probably has access to the ACTUAL evidence against these guys.
Sure he does. Or, rather, he could get the evidence if he wanted to. Lord knows reporters from McClatchy and National Journal have been able to determine that most GTMO detainees aren’t, in fact, the "worst of the worst," contraDonald Rumsfeld. So why doesn’t McCain try?
I’d submit that it’s because the political disincentives to seeing the evidence are pretty significant. If you see how flimsy the evidence is against most detainees, and it becomes known that you’ve seen it, then you’d face embarrassing public questioning about why you didn’t do more to stop the show trials. After all, the second you start to make too much noise about GTMO, the Pentagon would immediately leak that you’ve had all this access, to put you into precisely such a bind. Much much safer to plead ignorance and trust the Defense Department and acquiesce to injustice. For that matter, this goes for Sen. Barack Obama (D-Ill.), too.
