In Wyoming, both medicinal and recreational cannabis are outlawed. However, the law authorizes the possession and consumption of high CBD and low THC (less than 0.3%) products if prescribed by a physician. Wyoming does not have a medical or recreational cannabis program. The state has introduced three legalization measures since 2015, but all have failed. Possible penalties

Possession of fewer than 3 ounces of cannabis in Wyoming is a misdemeanor and can result in a maximum of twelve months in jail and $1,000 in fines. Possession of more than three ounces of cannabis is a felony and can get you up to five years in prison and $10,000 in fines.  If caught with any amount of cannabis resinous extract (hash or honey oil), you face felony charges and receive up to five years in prison and a $10,000 fine. Cultivation (even if you only have one plant) of any amount of cannabis is a misdemeanor and can result in six months in prison and a $1,000 fine. The penalties for selling cannabis in Wyoming are even more severe. If you are caught selling any amount of cannabis, you face imprisonment of up to ten years and a $10,000 fine.

Wyoming Medical Marijuana Program

Wyoming currently does not have a medical cannabis program. In the past, there were two failed initiatives to create one. There are now two active bills in the state legislature to create a medical cannabis program. If one passes, the program would likely be modeled after the Utahcannabis program. The Utah program allows patients to purchase cannabis products from licensed dispensaries and grow six plants at home. A bill would allow WY physicians to issue a written certification for medical cannabis for any condition that would qualify for a prescription in another state. The other bill would create a state-regulated program. There does not seem to be much momentum behind either bill, so it is unlikely that the legislature will pass either in the next two years.

CBD regulations

Wyoming allows the possession of cannabis products that contain high CBD and low THC (less than 0.3%). However, the state has not provided specifics on what is considered high CBD and low THC. Currently, there are no medical cannabis products for sale in Wyoming. If one of the medical cannabis bills passes, patients would be able to purchase high CBD and low THC products. CBD products containing THC below 0.3% are currently legal in Wyoming, but the products are hard to come by and expensive. Intractable epilepsy patients can apply for a CBD exemption if they can’t find the needed products.

Can You Grow Your Weed?

Although it is legal to grow cannabis in Wyoming, it is unlikely that you will be able to find seeds or clones in the state. Growing cannabis indoors is recommended, but outdoor cultivation is also possible if you live in a warm climate. Growing cannabis indoors is more energy-intensive than outdoor cultivation, so choosing a high-yielding strain that produces good yields per square foot is essential. If you have no prior experience, consider growing low-yielding hybrid strains. If you are more skilled and want to experiment with high-yielding Sativa or high-CBD strains, go for it!
